  1. Zuberance Privacy Policy

    At Zuberance, Inc. ("Zuberance", "us" or "we"), we respect the privacy rights of our online visitors ("you") and recognize the importance of protecting the information we collect about you. Our privacy policy ("Privacy Policy") is designed to help you understand how we collect and use such information. The Privacy Policy applies to our website ("Site"), including emails and any services we offer on or through the Site ("Services").

    This Privacy Policy governs our use and disclosure of information that you provide when using our Services, technical information about the computer you may be using to access the Site, or information that our third party business partners may provide to us. This Privacy Policy does not apply to the practices of other websites or companies that we do not own or control, including but not limited to unaffiliated third party websites, services and applications that you may access through use of the Services ("Third Party Services"). We take no responsibility for the privacy policies associated with any Third Party Services and we encourage you to review the privacy policies of each of these sites.

    1. Types of Information

      We may collect the following types of information when you visit the Site or use the Services: End User Information: It is possible to use the Services without providing any personal information. However, there are instances where you must provide us with certain personal information in order to take full advantage of the Services ("End User Information"). End User Information may include but is not limited to name, screen name, and valid email address.

      Content: By using the Services, you acknowledge that your reviews, photos, videos, opinions, messages, screen name and other such content you post to publicly facing sites ("Content") is intended to be posted for public consumption. We may display such Content on the Site and facilitate distribution to a wider audience through Third Party Services. Depending on what you elect to post, Content may or may not personally identify you. We provide our customers with your Content so that they might improve the products and services that you are evaluating through your use of the Services.

      Log Information: When you access the Services, we record information about your visit, whether or not you formally submit End User Information. This may include but is not limited to your Internet Protocol address, browser type, internet service provider, referring and exit pages, operating system, date-time stamp, central processing unit on your computer, and clickstream data ("Log Information"). Log Information is not linked to any personally identifiable information and it is used to administer, track and improve the Services and gather general demographic information about our user base as a whole.

      Cookies: We store certain information from your browser using unique identifiers known as "cookies". "Cookies" are small text files that are stored on your computer when you visit a website and transmit information about you and your use of the Site. They identify your computer, but not you personally. You may disable cookies; however doing so may limit the functionality of the Services.

      Third Party Information: We may receive certain non-personally identifiable demographic information (such as zip code) from our partners ("Third Party Information"), and we may combine this information with what we have collected from your Log Information, Cookies, and/or your use of the Services. "Content" is not considered "Personal Information" for the purposes of this Privacy Policy; however, depending on what you choose to publicly share, Content may identify you personally. Unless otherwise defined, references to "information" generally include any and all types of information described herein. In the event that we directly combine Personal Information with the other types of information described herein, the combined information is treated as Personal Information under this Privacy Policy.

    2. Use of Information

      We use the information we receive about you in order to enable you to use the Services, communicate with you and fulfill your requests, personalize your experience, display relevant advertising, contact you about products and services that may be of interest to you, back up our systems, improve the Services, and comply with our legal obligations.     3. Disclosure of Information

      Personal Information is never sold to a third party, however we may share your information with third parties in the following circumstances: (a) we share your information with the company providing the product or service that you are evaluating through your use of the Services, which use will be subject to each respective company's own privacy policy; (b) we may share your Log Information and/or Cookies with third parties generally for direct marketing purposes in order to provide targeted advertising for other products and services that may be of interest to you; (c) we may share your information with our subsidiaries, affiliates or service partners in order to process information on our behalf or to assist us with providing the Services, including certain marketing efforts. Prior to sharing your Personal Information, we require that any such subsidiary, affiliate or service partner agree to process your information in compliance with this Privacy Policy, and honor strict confidentiality and security requirements as dictated by Zuberance; (d) we have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to: (i) satisfy any applicable law, regulation, legal process or governmental request; (ii) detect, prevent, or otherwise address potential wrongdoing, fraud, security or technical issues; (iii) protect against imminent harm to the rights, property or safety of Zuberance, its users or the public as required or permitted by law; or (iv) enforce applicable Terms of Service, including investigation of potential violations thereof; (e) we become involved in a merger, acquisition, or any form of sale of some or all of our assets; or (f) where we have your consent.

      Third parties with whom we have shared your information may independently obtain other demographic data about you in the event they choose to use their own cookies, pixel tags, or other such mechanisms. We are not responsible for the information gathered by these third parties. You expressly authorize us to collect, use, disclose and retain any information that we, in our sole discretion, deem necessary for the purposes mentioned above.

  4. EU Safe Harbor Participation

    Zuberance adheres to the "Safe Harbor" framework that was established by the U.S. Department of Commerce in consultation with the European Commission regarding the collection and use of data from the European Union.

  5. Children Under 13

    Zuberance does not knowingly collect or solicit information from any child under the age of 13, nor do we knowingly allow such persons to submit End User Information in order to utilize the Services. In the event that we learn that a child under age 13 has submitted End User Information without verification of parental consent, we will delete such information immediately.   6. Opt-Out

    We provide you with the opportunity to "opt-out" of any further communications from Zuberance in connection with a product or service offered on behalf of a particular company. We may contact you in connection with a product or service offered on behalf of a different, unrelated company, at which time you will again be given the opportunity to opt-out. Any opt-out requests we receive are communicated directly to the company offering the product or service for which the Services are provided within 72 hours of receiving your request. Should you wish to do so, you may follow the opt-out instructions provided in each Zuberance communication.

  7. Retention of Information

    We may retain information we collect for as long as is permitted or required by law in order to comply with laws or for other legitimate business purposes. Note that any information or Content generated by you will remain stored by Zuberance and may remain publicly visible.

  8. Security

    We take security very seriously, and we use generally accepted industry standards to protect the information collected through your use of the Services. Among other things, we require password protections, and we maintain physical, electronic, and procedural safeguards to protect against accidental or unauthorized alternation of your information. Access to End User Information is limited to employees and designated agents of Zuberance, each of whom is required to sign a confidentiality agreement. However, given the inherent risks in submitting information through the Internet, we are not able to guarantee complete security.

  9. Changes in Privacy Policy

    We reserve the right to change our Privacy Policy at any time, and you are bound by the Privacy Policy in effect at the time you access the Services. If there is a material change to this policy, we will notify you here by indicating a new effective date at the top of this page, by email or through a notice located on our home page. We encourage you to refer to this policy on an ongoing basis.

  10. Notice to California Users

    California residents may obtain specific disclosures of business privacy practices if a company shares information with other companies for direct marketing purposes. Such users may request and obtain from us once a year, free of charge, information about the Personal Information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year.
